It is a person appointed by a Court to take control of a business and its assets.

Because the Securities Commissioner for the State of Colorado ("Commissioner") requested a receiver be appointed and XXXXXXXX agreed to the appointment.  I won't speculate on why the Commissioner made the request or why XXXXXXXX agreed to the appointment.

Primarily in bankruptcy proceedings, I have considerable experience in administering matters such as this.  The Commissioner, XXXXXX agreed to my appointment.  And, finally, the District Court Judge appointed me.

Subject to Court supervision and approval, they are very broad.  You should review the Order appointing me as receiver, which is listed in the pleadings section of this page for the details.  In summary, I act as the officer, director, manager of the businesses subject to the receivership.  Among many other things, I can prosecute the XXXXXXXX litigation claims, collect their assets, and distribute the proceeds to the holders of claims.

We are paid, subject to Court supervision, from the assets of the receivership estate.

What Are You Doing to Get Our Investments Back For Us?Use SHIFT+ENTER to open the menu (new window).
I'm working with four other lawyers, so far, in my firm to investigate the status of the various investments and establish a plan to recover as much as is possible.  If necessary, and to the extent the receivership estate's resources will allow it, I may pursue litigation claims to collect on investments.

No.  We represent the receivership estate, which you may benefit from, but I am not your lawyer and my counsel does not act as your lawyer, either.  I recommend that you retain your own counsel.  I would be happy to speak with your counsel.

I don't know, which will be the source of considerable frustration for many of you.  I will work hard to recover as much as I can, but until we get to the very end of the process, I am not be able to give you an informed estimate of the likely return.

This is another area of considerable frustration because, again, I just don't know.  My experience is that it always takes longer than anyone would like, but at this time I cannot give you a reasonable estimate of when this will be resolved.

I will file a motion with the Court to establish a claim process.  I plan on filing the motion within the next couple of weeks.  Assuming it is approved, then I will post the process on this web page and give notice to all known investors.

Yes.  I always recommend that investors who find themselves in a case like this retain their own counsel.
